Terms of Service

Effective Date: March 25, 2026

Summary: By using Intentional, you agree to these terms. Subscriptions auto-renew unless cancelled. Emergency passes reset on a rolling basis. The AI judge's decisions are final within the app. Be respectful and don't misuse the service.

1. Acceptance of Terms

By downloading, installing, or using Intentional ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and SHM Ventures LLC ("we," "our," or "us").

2. Description of Service

Intentional is an AI-powered digital wellness app that helps users reduce unintentional screen time. The App:

Blocks selected apps on your device using Apple's Screen Time / Family Controls framework
Presents an AI judge when you attempt to open a blocked app
Evaluates your justification for access and grants or denies a timed unlock
Tracks focus scores, streaks, and usage insights to build long-term habits
Offers multiple judge personas and difficulty levels

3. Eligibility

You must be at least 13 years old to use Intentional. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have parental or guardian consent to use the App.

4. Account & Device

You may use the App as a guest or create an account using Apple Sign-In or email. You are responsible for:

Maintaining the security of your device and account credentials
All activities that occur through your use of the App
Linking an account if you wish to preserve your data and subscription across devices

5. Subscriptions & Payments

5.1 Subscription Terms

Intentional offers subscription plans that unlock premium features including unlimited block configurations, additional judge personas, and enhanced analytics:

Payment will be charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel your subscription in your App Store account settings
Any unused portion of a free trial period will be forfeited when you purchase a subscription

5.2 Emergency Passes

Emergency passes allow you to bypass a block without arguing:

Free users receive a limited number of passes per rolling 7-day period
Pro subscribers receive additional passes per period
Passes reset on a rolling 7-day basis, not on a calendar week
Passes are non-transferable and have no monetary value

5.3 Refunds

All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple. We cannot process refunds directly.

6. Free Tier

New users may use core features of the App at no cost with the following limitations:

Limited number of block configurations
Limited emergency passes per 7-day period
Access to a subset of judge personas
Basic insights and analytics

7. Screen Time & Family Controls

Intentional uses Apple's Family Controls entitlement (com.apple.developer.family-controls) to enforce app blocks at the system level. By using the App, you understand and agree that:

The App will request access to Screen Time / Family Controls on your device
Granting this permission is required for core blocking functionality
The App blocks and unblocks apps on your device as configured by you
Timed unlocks will automatically re-block apps when the granted time expires
This permission does not give us access to monitor your browsing history, messages, or personal files

8. Acceptable Use

You agree NOT to:

Attempt to circumvent or manipulate the blocking or negotiation system
Submit false, misleading, or abusive content during negotiation sessions
Reverse engineer, decompile, or disassemble the App
Use the App for any commercial purpose without authorization
Interfere with or disrupt the App's servers or networks
Create multiple accounts to abuse free tiers, trials, or promotions
Attempt to access another user's account or data

9. AI Judge Decisions

Important: The AI judge's verdicts (approved/denied) are generated by artificial intelligence and are:

Based on the quality and context of your argument
Not guaranteed to be consistent or perfectly fair
Final within the App — we do not manually override AI decisions
Not a substitute for professional mental health or addiction support

Intentional is a productivity tool, not a medical device. If you are struggling with compulsive phone use, please seek professional support.

10. Intellectual Property

10.1 Our Content

The App, including its design, features, AI judge system, personas, and content, is owned by SHM Ventures LLC and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

10.2 Your Content

You retain ownership of any content you provide, including negotiation messages and voice recordings. By using the App, you grant us a limited license to process this content solely for the purpose of providing our services.

11. Privacy

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The App will be uninterrupted, error-free, or always available
App blocking will prevent all access in every scenario
The AI judge will always make decisions that align with your expectations
The App will be compatible with all devices or iOS versions

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHM VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless SHM Ventures LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

15. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination:

Your right to use the App ceases immediately
Active subscriptions remain subject to App Store refund policies
Unused emergency passes are forfeited

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the new Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

18. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
